Biden FBI’s Arctic Frost surveillance of lawmakers could cost the government, thanks to ‘real teeth’ measure in funding bill
Republican lawmakers officially passed their funding bill to reopen the government on Monday night. In addition to getting the ball rolling on reopening the government, their bill sets the stage for possible retribution over the Biden FBI’s Arctic Frost operation.
Senate Judiciary Committee Chairman Chuck Grassley (R-Iowa) published damning documents last month regarding the Biden FBI’s Operation Arctic Frost, an investigation that ultimately morphed into former special counsel Jack Smith’s federal case against President Donald Trump regarding the 2020 election.

The documents revealed that the bureau not only subpoenaed records for over 400 Republican individuals and entities but secretly obtained the private phone records of numerous Republican lawmakers as part of what the Iowa senator called a “fishing expedition.”
According to the Grassley, those behind Arctic Frost “were spreading a wide net because they were looking for anything they could to hook on Trump, put Trump in prison, keep him from running for president, and things of that nature.”
The funding bill passed by the Senate this week contains a provision that would enable any senator whose phone records were “acquired, subpoenaed, searched, accessed or disclosed” without his or her knowledge to file a civil lawsuit against the government inside the next five years for at least $500,000 plus legal fees for each instance of a violation.
Senators would be able to take legal action if at the time their records were seized, they were a target of a criminal investigation; a federal judge issued an order authorizing a delay of notice to the senator in question; the government complied with the judge’s order; and the subpoena was faithfully executed.

The provision, which is retroactive to 2022, notes that “no officer, employee, or agent of the United States or of any Federal department or agency shall be entitled to assert any form of absolute or qualified immunity as a defense to liability” in relation to such violations.
“It’s designed to put real teeth into federal law that prohibits the executive branch from surveilling the Senate,” Sen. Ted Cruz (R-Texas) — whose Senate office hard-line and cellphone records were reportedly targeted — told the Daily Caller. “Arctic Frost was a grotesque abuse of power. It was Joe Biden’s Watergate.”
“[It’s] a common-sense provision to ensure that no Department of Justice — Democrat or Republican — ever does that again,” added Cruz, who confirmed to Politico that Majority Leader John Thune (R-S.D.) was “directly” responsible for the inclusion of the provision.
Senate Majority Whip John Barrasso (R-Wyo.) told the Daily Caller the provision serves to protect against “a weaponization of government against members of the Senate” and stressed that “senators are going to take responsible action, and that’s what we’ve done here.”
Democrat lawmakers complained about the measure.
“I’m shocked that a huge change in policy would be dropped into a bill at the last minute, and the first that most senators learn about it is in the press,” Sen. Elizabeth Warren (D-Mass.) told the Caller. “This is one more way in which the bill that passed the Senate tonight is even worse for the American people.”
Sen. Martin Heinrich (D-N.M.) similarly clutched pearls over the provision, telling Politico, “I am furious that the Senate minority and majority leaders chose to airdrop this provision into this bill at the eleventh hour — with zero consultation or negotiation with the subcommittee that actually oversees this work.”

‘Unfit for the gavel’: House GOPs sound off on Judge Boasberg, stand with senators in calling for impeachment
House Republicans are ramping up the pressure on activist judges in the wake of the bombshell findings about Operation Arctic Frost.
The revelations concluded that former President Joe Biden’s FBI targeted conservative groups, private citizens, and even sitting senators. One recurring name in a thread of surveillance scandals is James Boasberg, chief judge of the U.S. District Court for the District of Columbia, who greenlit the subpoenas that targeted Republicans.

In light of his involvement, a growing number of House Republicans are standing with outraged senators in calling for his impeachment.
“It is clear that Judge Boasberg has abused his judicial authority for weaponized political purposes,” Republican Rep. Marlin Stutzman of Indiana told Blaze News. “His unconstitutional blocking of President Trump from making America great again and involvement in Arctic Frost are reason enough to remove him from the bench. Impeachment hearings should begin immediately.”

“A judge waging lawfare against elected senators of the United States and weaponizing their power for political gain should be impeached,” Republican Rep. Mark Harris of North Carolina told Blaze News. “Full stop.”
Republican Rep. Brandon Gill of Texas took matters into his own hands and introduced articles of impeachment against Boasberg to “hold him accountable for his attempt to undermine the will of the people.”
“Radical activist Judge James Boasberg continues to weaponize his judicial authority and target his political opponents,” Republican Rep. Brandon Gill of Texas told Blaze News. “Judge Boasberg facilitated the egregious Arctic Frost scandal where he equipped the Biden DOJ to spy on Republican senators. His lack of integrity makes him clearly unfit for the gavel.”
Republican Rep. Josh Brecheen of Oklahoma called Arctic Frost a “Watergate-level scandal,” saying the only way to restore faith in the legal system is to impeach activist judges like Boasberg.
“Under a directive from Special Counsel Jack Smith, the Biden DOJ spied on almost every major conservative group — including the Trump campaign and the RNC,” Brecheen told Blaze News. “This is a Watergate-level scandal for which accountability must be had. We must take all the steps available under law to pursue justice and restore the American people’s faith in our legal system. This starts with beginning the impeachment process for any corrupt judges involved in this scandal.”

Gill’s fellow Texan Republican Rep. August Pfluger also railed against Boasberg’s involvement in the surveillance effort, calling for an investigation. Pfluger likewise joined Brecheen to urge Attorney General Pam Bondi to investigate Jack Smith and “every single Biden-era DOJ bureaucrat” who partook in this scandal.
“Jack Smith’s ‘Arctic Frost’ investigation into President Trump, Republican lawmakers, and conservative groups has turned out to be exactly what we expected: an unconstitutional political witch hunt,” Republican Rep. August Pfluger of Texas told Blaze News. “The weaponization of our nation’s top law enforcement agency to target political opponents is unacceptable, especially in the United States.”
“These individuals must be held accountable to the fullest extent of the law — and we will ensure this kind of blatant corruption never happens again.”
The House has the sole authority to introduce articles of impeachment for a judge, and just a simple majority is needed to pass them. Republicans hold a slim majority in the House, 219-213.

Boasberg is one of many low-court judges who have shown themselves to be lawless political actors whose jurisprudence is hostile to a functioning republic.

The liberal media wasted a great deal of airtime and ink over the past decade fearmongering about the Russian collusion narrative but clammed up earlier this year when the Trump administration produced receipts demonstrating that the basis of multiple investigations and numerous arrests was nothing more than a hoax perpetrated on the American people by the Obama administration.
In the wake of revelations this week about Operation Arctic Frost — chiefly about the Biden FBI’s surveillance of Republican lawmakers and indiscriminate targeting of conservatives — the liberal media has once again proven strategically incurious, evidencing the unidirectional nature of their outrage.
‘They screamed when Nixon’s “enemy list” was exposed.’
The New York Times, for instance, has concern–mongered in recent weeks about personnel changes at the Justice Department and the Trump administration’s alleged use of “the federal government’s vast intelligence gathering and law enforcement authority to cast the specter of criminality on Mr. Trump’s enemies.”
However, with the apparent exception of an Oct. 7 article focusing on Republican denunciations of special counsel Jack Smith’s covert collection of lawmakers’ phone records and an Oct. 21 article boosting denials issued on Smith’s behalf by his lawyers, the Times has avoided troubling itself with questions about Arctic Frost or the latest documents highlighting the Biden FBI’s targeting of conservatives.
The Times was far from the only liberal publication to ignore the documents released this week by Iowa Sen. Chuck Grassley (R) and the House Judiciary Committee revealing the massive scope of the Arctic Frost dragnet.
The Washington Post, CBS News, ABC News, and the Atlantic similarly appear to have largely ignored the matter, publishing little to nothing this week on the latest bombshells.

CNN’s coverage this month appears to be limited to a piece boosting denials on Smith’s behalf and an analysis piece by senior reporter Aaron Blake, who did his apparent best to downplay the finding that Smith had covertly obtained the phone records of Republican lawmakers.
Blake claimed that the “GOP is exaggerating the evidence”; that the evidence does not “fit what is traditionally understood to constitute ‘spying'”; that the surveillance of lawmakers’ communications is not unprecedented; and that “we certainly don’t have evidence that it was done for political purposes.”
While MSNBC, NBC News, and Politico seemed interested in engaging with the story prior to this week, their efforts were apparently focused on downplaying the findings, portraying Smith as a victim, and painting Arctic Frost as an apolitical investigation and Republicans’ concerns as unhinged.
Trump ally Roger Stone noted, “They screamed when Nixon’s ‘enemy list’ was exposed. Why aren’t the media and the Democrats talking about the Arctic Frost TARGET LIST — the ultimate weaponization of the criminal justice system?”
Tom Bevan, the president of RealClearPolitics, expressed amazement, writing on Thursday morning, “No mention of Arctic Frost in the NY Times or the Washington Post. These are not ‘news’ organizations any more.”
Bevan added, “Same on CNN, ABC News, CBS News … and NBC News. Not. One. Story.”
Sen. Ron Johnson (R-Wisc.) said Wednesday that what is revealed in the latest document dumps regarding Arctic Frost “is nothing short of a Biden administration enemies list. I’m old enough to understand how toxic a term that was under Richard Nixon. This is far worse — far worse, orders of magnitude worse.”

If it’s ‘worse than Watergate,’ then why the media blackout?
In a sense, this is old news. In December 2021, CNN reported that the House’s January 6 committee had subpoenaed phone records of more than 100 people.
But that was mostly Trump officials, including White House Chief of Staff Mark Meadows. No surprise there. After all, the January 6 Select Committee was empaneled for the specific purpose of turning President Donald Trump into a criminal for supposedly aiding and abetting the Jan. 6, 2021, breach of the Capitol.
It is well past time for the Republican Congress to fulfill its promise to hold accountable those who weaponized the federal government against Trump and his allies.
But when this story resurfaced earlier this month, there was something new, too. For one thing, the scope of the investigation was almost unbelievable — it turns out those subpoenaed phone records consisted of a staggering 30 million lines of phone data.
And when the select committee’s investigation went nowhere, one of the members — GOP malcontent and former Rep. Adam Kinzinger (Ill.) — informed the FBI about the phone data in Dec. 2023 when it was becoming apparent that Trump was the favorite to win the Republican nomination in 2024.
Greater than Watergate
More revelatory than the numbers of the phone records hauled in by the J6 committee was the news that the FBI had gone after these same records — and possibly more — in an effort to target Trump and his conservative allies. Not only did the agency have its eyes on Trump, it also went after nine Republican members of Congress — eight senators and a stray congressman, in an obvious effort to sweep up accomplices in the coup that never was.
Whether the FBI obtained the same phone records as the J6 committee is unclear. Kinzinger’s tip may have been moot, because an FBI memo released by Sen. Chuck Grassley (R-Iowa) shows that by September 2023, the agency had already “conducted preliminary … analysis” on the call data of several members of Congress, including Sens. Lindsey Graham (R-S.C.), Bill Hagerty (R-Tenn.), Ron Johnson (R-Wis.), and Marsha Blackburn (R-Tenn.).
According to CNN, “The FBI, as part of special counsel Jack Smith’s Jan. 6 investigation, used court orders in 2023 to obtain the phone records of nine GOP lawmakers.” These were not actual phone calls or text messages, but rather information about who called or texted whom and when.
Grassley posted the memo to his X account, with the message:
This document shows the Biden FBI spied on 8 of my Republican Senate colleagues during its Arctic Frost investigation into “election conspiracy.” Arctic Frost later became Jack Smith’s elector case against Trump.
He concluded, in all caps: “BIDEN FBI WEAPONIZATION = WORSE THAN WATERGATE.”
Which raises the question: Why did the story turn out to be a one-day wonder? Here we have the discovery of a partisan investigation seeking to uncover dirt on fellow members of Congress (if the records did indeed start with the J6 committee), or at the very least a rogue element of the executive branch targeting political enemies in the legislative branch.
As Johnson said:
They’re casting this net, this fishing expedition against members of the Senate and the House. There is no predicate. There’s no reason for this other than a fishing expedition, which, again, should outrage and shock every American.
Once again, a member of Congress implied that we are witness to a political scandal (one of many in the Biden administration) that is among the worst in our history. Yet when you do a Google search for stories related to phone toll records being subpoenaed by either the J6 committee or the FBI, virtually nothing comes up beyond Oct. 7, the day after Grassley released the memo.
Crickets …
A few news outlets reported in the following days that FBI Director Kash Patel had fired agents involved in the Arctic Frost investigation. In addition, scattered reports surfaced on Hagerty questioning why Verizon released his phone records without informing him.
Verizon told Fox News Digital:
Federal law requires companies like Verizon to respond to grand jury subpoenas. We received a valid subpoena and a court order to keep it confidential. We weren’t told why the information was requested or what the investigation was about.
Grassley and Johnson followed up with their own letter to Verizon and three other telecommunication companies demanding to be supplied with the same data that was provided to the FBI or special counsel Jack Smith. In addition, the senators expressed their belief that the records should have been privileged because they concerned the official constitutional duties of certifying the 2020 presidential election.
It seems like a real story — one that deserves the full attention of the press — but where are the special investigation teams at the New York Times and the Washington Post? What have you heard about this story on CBS, NBC, and ABC newscasts? Very little if anything. Certainly nothing in comparison to the coverage provided to Watergate.
Most recently, Rep. Jim Jordan (R-Ohio), who chairs the House Judiciary Committee, sent a letter to Smith demanding a transcribed interview and documents along with communications related to his investigation of Trump. Well and good, but that interview will be conducted in secret, as were the interviews of Smith’s subordinates — one of whom, according to Jordan, “invoked the Fifth Amendment approximately 75 times.”

Time for Congress to step up
It is well past time for the Republican Congress to fulfill its promise to hold accountable those who weaponized the federal government against Trump and his allies. Press releases and secret interviews won’t do the job. We need public televised hearings, with witnesses ranging from members of the J6 committee, including Kinzinger, former Rep. Liz Cheney (R-Wyo.), and now-Sen. Adam Schiff (D-Calif.), to former FBI Director Christopher Wray and Jack Smith.
Would the legacy media networks cover it? Probably not, because as we all know by now, those outfits are still after Trump’s scalp, and they will only seek to discredit Jordan and the other congressional investigators who want to know the truth. That doesn’t mean Republicans should give up.
Watergate started as a one-day story about a botched break-in. But even without Woodward and Bernstein, the famous team of reporters from the Washington Post, the story would never have been kept quiet unless Senate Democrats and congressmen didn’t do their job.
Now it’s time for Jordan, Grassley, and Patel to do theirs.
